Terms of Service
Last updated: October 10, 2026
These Terms of Service ("Terms") govern access to and use of FenixCloud, a point-of-sale and ordering platform provided by FenixCloud ("we", "us", "our"). By creating an account or using FenixCloud, you agree to these Terms on behalf of yourself and the business you represent ("you", "your business").
1. The service
FenixCloud provides point-of-sale, ordering, inventory, staff, and related business-management tools, including optional WhatsApp-based ordering and notifications, delivered as a cloud-hosted subscription service.
2. Your account
You're responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that happens under your account, including actions taken by staff members you invite.
3. Acceptable use
You agree not to use FenixCloud for any unlawful purpose, to misrepresent your business, to interfere with the service's operation or security, or to use it to send unsolicited messages. We may suspend or terminate accounts that violate this section.
4. Fees and billing
Paid plans, if applicable, are billed in advance on a recurring basis as described at signup or in your plan details. Fees are non-refundable except where required by law.
5. Your data
You retain ownership of the business, product, order, and customer data you enter into FenixCloud. We process it as described in our Privacy Policy. You're responsible for having the right to collect and store any customer data you enter.
6. Third-party services
FenixCloud integrates with third-party providers — for example, WhatsApp/Meta for messaging, email delivery providers, and payment or invoicing providers you choose to connect. Your use of those providers is also subject to their own terms.
7. Termination
You may stop using FenixCloud at any time. We may suspend or terminate access for violation of these Terms, non-payment, or to comply with legal requirements, with notice where reasonably possible.
8. Disclaimers and liability
FenixCloud is provided "as is." To the extent permitted by law, we disclaim warranties of any kind and are not liable for indirect, incidental, or consequential damages arising from your use of the service.
9. Changes to these Terms
We may update these Terms from time to time. Continued use of FenixCloud after an update means you accept the revised Terms.
